Acceptance of Terms
By accessing or purchasing from this website, you agree to be bound by these Terms and Conditions and all applicable laws. If you do not agree, please do not use this site. These terms apply to all visitors, customers, and users of the XIX Brands website, whether purchasing as an individual consumer or on behalf of a business.
Eligibility
You must be at least the age of majority in your province or state of residence to make a purchase. By using this site, you confirm that you meet this requirement. If you are placing an order on behalf of a business, you represent that you have the authority to bind that business to these Terms.
Custom Orders & Proof Approval
All custom orders require approval of a digital proof before production begins. By approving your proof, you accept full responsibility for the accuracy of all content, including text, artwork, spelling, layout, colours, and sizing. XIX Brands will produce items as shown in the approved proof. Changes requested after proof approval may result in additional charges or delays.
Artwork & Intellectual Property
By submitting artwork, logos, or design files, you represent and warrant that you own or have the right to use that intellectual property and that its use by XIX Brands for production purposes does not infringe on the rights of any third party. XIX Brands reserves the right to decline any order involving artwork that appears to infringe on third-party intellectual property rights.
All content on this site including logos, images, product descriptions, and copy is the property of XIX Brands. You may not reproduce, distribute, or use this content without our express written consent.
Products & Pricing
We reserve the right to modify product descriptions, pricing, and availability at any time without notice. We make every effort to display product colours and specifications accurately, but screen displays and print results may vary. Custom colour matching is subject to the limitations of the printing process and substrate selected. All offers are subject to availability.
Orders & Payment
Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order at our discretion, including orders involving prohibited content, fraudulent activity, or intellectual property concerns. You agree to provide accurate billing and payment information.
We accept major credit and debit cards and PayPal as payment methods. PayPal is provided by PayPal, Inc. and operates under PayPal's own User Agreement and Privacy Policy. When paying via PayPal, your transaction is processed directly by PayPal and XIX Brands does not receive or retain your payment credentials. Disputes regarding PayPal transactions should be directed to PayPal in the first instance, though we are happy to assist in resolving any order-related concerns.
Order Confirmation
You will receive an order confirmation email upon successful checkout. XIX Brands reserves the right to cancel or adjust any order due to product availability, pricing errors, or payment issues. We will contact you promptly if any issue arises with your order.
Prohibited Content
XIX Brands will not produce items containing content that is unlawful, obscene, defamatory, discriminatory, harassing, or that infringes on any third party's intellectual property or other rights. We reserve the right to refuse any order at our sole discretion.
Prohibited Uses
You agree not to use this site to: (a) engage in unlawful activity; (b) upload malicious code or viruses; (c) harvest personal information of others; (d) impersonate another person or entity; (e) infringe on any intellectual property rights; or (f) interfere with site security or operation.
Disclaimer of Warranties
This site and all products are provided 'as is' and 'as available' without warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
Limitation of Liability
XIX Brands shall not be liable for any indirect, incidental, special, or consequential damages arising from use of this site or purchase of our products, to the fullest extent permitted by applicable law.
Governing Law
These Terms and Conditions are governed by the laws of the Province of British Columbia, Canada. Any disputes shall be resolved in the courts of that jurisdiction.
